Terms of Agreement

3.1 Account Creation

To publish content or access certain features, you must create an account. You must provide accurate, current, and complete information during registration and keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have parental or guardian consent to use the Service. By creating an account, you represent that you meet these eligibility requirements.

4.1 Original Content Requirement

YOU MAY ONLY POST CONTENT THAT YOU HAVE CREATED YOURSELF OR HAVE EXPLICIT WRITTEN PERMISSION TO POST.

By posting any content on Minkly.io, you represent and warrant that:

• You are the original author and copyright owner of the content, OR
• You have obtained all necessary rights, licenses, and permissions from the copyright owner(s)
• Your content does not infringe, violate, or misappropriate any third-party rights, including copyright, trademark, or other intellectual property rights
• Your content is not plagiarized from any source

4.2 Zero Tolerance for Copyright Infringement

We have a zero-tolerance policy for copyright infringement. Users who post content they did not create or do not have permission to post will have their accounts immediately terminated. This includes but is not limited to:

• Stories copied from other platforms, websites, or publications
• Translations of others' work without authorization
• Modified versions of existing stories without permission
• Any content subject to third-party copyright claims
• Plagiarized content from any source

Exception for Fan Fiction: Fan fiction is permitted under strict conditions (see Section 4.6)

4.3 User Content License

You retain full ownership and copyright of your original content posted on Minkly.io ("User Content"). By posting User Content, you grant Minkly.io a limited, worldwide, non-exclusive, royalty-free, revocable license solely to:

• Display and distribute your content on the Platform
• Create necessary technical copies for caching and display purposes
• Allow other users to read and interact with your content as per your chosen settings
• Include excerpts in promotional materials for the Platform (with attribution)
• Process your content through AI systems for enabled features (see Section 9)

This license does NOT include rights to:

• Sell or commercially exploit your content
• Create derivative works beyond technical requirements and AI features you've enabled
• Transfer rights to third parties
• Use your content outside the Platform without your permission
• Train AI models on your content (see Section 4.5)

4.4 Your Copyright Protection

You maintain all rights to your original work. You may:

• Remove your content at any time
• Set access restrictions (public, private, paid, etc.)
• Monetize your content through Platform features
• Publish your content elsewhere simultaneously
• Register copyright and pursue infringement claims independently

4.5 AI Training Prohibition

YOUR CONTENT WILL NOT BE USED FOR AI TRAINING.

Minkly.io explicitly commits that:

• User content will NEVER be used to train, fine-tune, or improve AI models
• Your stories, text, and creative works will NOT be included in any machine learning datasets
• We will NOT permit third parties to use your content for AI training purposes
• This prohibition is absolute and permanent for all user content
• This commitment can only be overridden by a separate, explicit partnership agreement between you and Minkly.io that specifically addresses AI training rights
• Any such partnership agreement would be entirely voluntary and would require your written consent

4.6 Fan Fiction Policy

Fan fiction is permitted on Minkly.io under the following STRICT conditions:

5.1 DMCA Notice Procedure

If you believe content on Minkly.io infringes your copyright, please submit a DMCA takedown notice containing:

• Identification of the copyrighted work
• URL or location of the infringing content
• Your contact information (name, address, email, phone)
• A statement of good faith belief that the use is unauthorized
• A statement under penalty of perjury that you are the copyright owner or authorized agent
• Your physical or electronic signature

5.2 Counter-Notice

If you believe your content was wrongly removed, you may submit a counter-notice with:

• Identification of removed content and its former location
• Statement under penalty of perjury that removal was mistaken
• Your consent to jurisdiction
• Your contact information and signature

5.3 Repeat Infringer Policy

Users who repeatedly infringe copyrights will be permanently banned. We maintain a three-strike policy:

• First violation: Content removal and warning
• Second violation: Temporary account suspension
• Third violation: Permanent account termination

6.1 Prohibited Content

You may not post content that:

• Infringes any copyright, trademark, or intellectual property rights (except properly tagged fan fiction per Section 4.6)
• Contains plagiarized material
• Violates any applicable laws or regulations
• Contains malware, viruses, or harmful code
• Promotes illegal activities
• Contains explicit sexual content involving minors
• Promotes hate speech, discrimination, or violence
• Harasses, threatens, or doxxes individuals
• Contains spam or misleading information
• Impersonates others or misrepresents affiliations
• Misrepresents fan fiction as original work

6.2 Content Ratings and Warnings

Authors must appropriately rate and tag their content for:

• Violence and gore
• Sexual content
• Profanity
• Sensitive themes
• Fan Fiction status (mandatory for all derivative works)

Failure to properly tag content may result in content removal or account suspension.

8.1 Content Control

Authors have full control over their published content, including:

• Editing and updating chapters
• Deleting content
• Setting publication schedules
• Controlling comments and reader interaction
• Setting access permissions
• Enabling or disabling AI features (TTS, image generation)

8.2 Plagiarism Protection

We provide tools to help protect your work:

• Automated plagiarism detection
• Digital timestamps of publication
• DMCA takedown assistance
• Content fingerprinting
• Report functions for users to flag stolen content

8.3 Revenue and Monetization

If monetization features are available:

• Authors retain rights to all earnings from their content
• Platform fees will be clearly disclosed
• Payment terms will be specified separately
• Authors may use other monetization methods outside the Platform
• Fan fiction is strictly prohibited from all monetization (see Section 4.6)

8.4 AI-Generated Features

Authors may choose to enable AI features for their content:

• Text-to-Speech (TTS) audio generation
• AI-assisted picture book creation
• Other AI enhancement features as available

Authors retain all rights to their original written content regardless of AI enhancements.

9.1 Text-to-Speech (TTS) Services

The Platform offers AI-powered text-to-speech features that allow:

• Authors to enable TTS for their stories
• Readers to listen to TTS-generated audio of enabled stories
• Authors to select voice preferences and settings

By enabling TTS for your content, you:

• Grant permission to process your text through AI systems for audio generation
• Acknowledge that generated audio files will be stored on our servers for playback
• Retain all rights to your underlying written content
• May delete generated audio files at any time through your account settings
• May disable TTS and remove all associated audio at any time
• Understand that if you update your text, you may need to regenerate audio

9.2 AI Picture Book Generation

Authors may use AI features to create illustrated versions of their stories:

• Upload images or use AI-generated images to accompany text
• Convert stories into picture book format
• Create visual adaptations of written content

9.3 Rights and Ownership of AI-Enhanced Content

• You retain full ownership of your original written content
• AI-generated audio files remain under your control with full deletion rights
• Rights to AI-generated images are subject to the AI service provider's terms
• The combination of your text with images (picture book) remains your creative work
• You control whether to enable or disable AI features for your content
• Upon account termination or content deletion, associated AI-generated files will be removed unless you choose to preserve them
• Your content is NEVER used to train our AI systems - AI features only process your content to generate output (audio/images) for your use

9.4 AI Feature Limitations and Disclaimers

• AI features are provided "as available" and may change or be discontinued
• We don't guarantee accuracy or quality of AI-generated content
• TTS may mispronounce names, words, or have other audio artifacts
• AI-generated images may not perfectly match your vision or description
• We are not responsible for any copyright issues arising from AI-generated content
• Authors are responsible for reviewing and approving all AI-enhanced versions
• AI systems process your content only to provide requested features, never for training purposes

9.5 Prohibited Uses of AI Features

You may not:

• Use AI features to create content that violates these Terms
• Generate images that infringe on others' copyrights or trademarks
• Create deepfakes or misleading content
• Use AI features to harass, defame, or harm others
• Attempt to extract or reverse-engineer AI models
• Use AI features for any illegal purpose

11.1 Comments and Reviews

Users may comment on and review stories. Comments must:

• Be constructive and respectful
• Not contain spoilers without warnings
• Not include personal attacks
• Comply with content guidelines

11.2 Following and Notifications

Users may follow authors and stories. Authors control notification settings and may block users if necessary.

12.1 Content Removal

We may remove content that violates these Terms immediately and without notice.

12.2 Account Actions

Violations may result in:

• Warnings
• Content removal
• Temporary suspension
• Permanent ban
• Legal action for severe violations

12.3 Appeals

Users may appeal enforcement actions by contacting support@minkly.io.

14.1 Platform Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

WE DO NOT:

• Guarantee content quality or accuracy
• Endorse any user content
• Verify copyright ownership claims beyond DMCA procedures
• Guarantee content availability or permanence
• Promise specific features or functionality

14.2 Content Disclaimer

We are not responsible for:

• User-generated content
• Copyright disputes between users
• Lost or deleted content (maintain your own backups)
• Third-party actions regarding your content

16.1 Termination by You

You may delete your account at any time. Upon deletion:

• Your profile will be removed
• Your content may be removed or anonymized per your choice
• You remain responsible for any prior violations

16.2 Termination by Us

We may terminate accounts that:

• Violate copyright laws
• Repeatedly violate Terms
• Engage in illegal activities
• Remain inactive for extended periods

17.1 Governing Law

These Terms are governed by the laws of [Insert Jurisdiction], without regard to conflict of law principles.

17.2 Dispute Resolution

Disputes shall be resolved through [binding arbitration/court proceedings] in [Insert Jurisdiction].

19.1 Entire Agreement

These Terms, plus our Privacy Policy and Community Guidelines, constitute the entire agreement.

19.2 Severability

19.4 Assignment

You cannot transfer your rights. We may assign our rights without restriction.
