Digital Millennium Copyright Act (DMCA) Policy

Copyright Infringement Notification

Minkly LLC ("Minkly," "we," "us," or "our") respects the intellectual property rights of others and expects users of Minkly.io (the "Site") to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond expeditiously to claims of copyright infringement committed using the Site that are reported to our designated Copyright Agent.

Reporting Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the Site, please notify our Copyright Agent by providing the following information:

  1. Identification of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works;
  2. Identification of the material that you claim is infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material on the Site;
  3. Your contact information, including your address, telephone number, and email address;
  4. A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  5. A statement by you, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; and
  6. Your physical or electronic signature (typing your full name will suffice as an electronic signature).

Counter-Notification

If you believe that material you posted on the Site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent. The counter-notification must include:

  1. Your physical or electronic signature;
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled;
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification; and
  4. Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal district court in which your address is located, or if your address is outside the United States, any judicial district in which Minkly LLC may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Minkly LLC has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. You may wish to consult with an attorney before filing a DMCA notification or counter-notification.

Additional Information

We may request additional information before removing any allegedly infringing material. Upon receipt of a valid DMCA notification, we will remove or disable access to the allegedly infringing material and notify the user who posted the material. We may also forward the complaining party's contact information to the user who posted the allegedly infringing material so that they may respond directly to the allegations.
